There is a significant shift occurring within the UGE (unidad de grandes empresas) - the Spanish government unit in Spain responsible for Digital Nomad residency applications - that every prospective self-employed applicant needs to understand.

Since late last year, a new, unofficial requirement has solidified: a mandatory demand for proof of registration as a self-employed worker in your country of origin. While this change wasn't an "overnight" policy update, it has evolved into a standard hurdle for almost every self-employed application we process.

The Conflict: Spanish Bureaucracy vs. Global Reality

In Spain, being self-employed (Autónomo) is a formal, day-one status that comes with an official certificate. The Spanish authorities are now applying this same logic to the rest of the world.

The problem? In many jurisdictions like the UK, US, and Canada, there is often no legal requirement—or even a mechanism—to "register" as self-employed the moment you start. You are simply a sole proprietor by virtue of doing the work, and you only become "official" in the eyes of your government when you file your first tax return.

Why is the UGE doing this?

From our professional perspective, this is a crackdown on "ghost" applications. The UGE wants to ensure that an applicant’s professional activity is real and established, rather than a situation "invented" simply to secure residency. This is particularly targeted at company owners who might choose to shift between dividends and self-employment income to meet residency criteria.

The Catch-22

It’s a classic bureaucratic deadlock:

  • The UGE wants a government-issued certificate proving you are self-employed now.
  • Your home country doesn't issue one because you haven't filed your end-of-year taxes yet.

Without a formal registry in your home country, proving you exist to a Spanish official who expects a stamped paper can feel impossible.

Leveraging Collective Wisdom

We are lucky enough to host what is—as of our last check—the largest Spain DNV-focused Facebook group. This gives us a unique vantage point to benefit from the collective wisdom of thousands of nomads and professionals.

As an agency, we are constantly testing and refining strategies to bridge this "proof gap" based on real-time feedback. Here are the current ideas we have for our three top countries:

Country If Already Self-Employed If NOT Yet "Official"
🇬🇧 United Kingdom SA103 "Orange Pages" from your most recent tax return. Letter From HMRC Confirming Your Registration: This letter features the date on which you registered.
🇺🇸 United States Schedule C (Form 1040) or official IRS Wage and Income Transcripts showing your 1099 income. Advance Quarterly Tax Payment (1040-ES): An IRS receipt for an estimated payment proves active, real-time trading.
🇨🇦 Canada Form T2125 (Statement of Business or Professional Activities) from your latest tax return. Certificate of Registration: An official document issued by a provincial or territorial government that proves a business name has been formally entered into their public record.
  • All documents must be notarized and apostilled, and accompanied by a sworn translation into Spanish.

💡 IMPORTANT: The 3-Month Rule

If there is one piece of advice we can give, it is this: Plan ahead. Do not wait until you are ready to apply to trigger your paper trail.

Although in some countries backdating is possible, it's strictly necessary show that you've been registered for at least 3 months before you submit your application. Showing a history of activity is the most effective way to satisfy the UGE that your professional situation is stable and legitimate.
