Your initial years on the Spanish Digital Nomad Residency (DNV) have flown by, you've almost reached the end of the A1 certificate, and you're ready to make the leap to self-employment.
Many are surprised to find out that this isn't a standard renewal - the Unidad de Grandes Empresas (UGE) treats this transition as a brand-new initial application (solicitud inicial).
The upside? Submitting a solid application with an indefinite contract will usually get you a full 3-year residence permit - whereas a standard renewal only grants two.
Timing Is Everything
Unlike standard renewals—which allow filing between 60 days before and 90 days after TIE expiration—this grace period does not apply to A1 modifications to self-employment.
To prevent a gap in continuous residency (which could reset your five-year countdown to long-term residency), your application must be submitted while your TIE and A1 certificate remain valid, within 30 days before or after your previous employment ends.
- Filing before your new contract starts: You can submit a formal commitment pledge (declaración responsable) agreeing to finalize your Autónomo setup on your contract start date.
- Filing after your new contract starts: You have up to 30 days from the start date to notify the UGE. However, because the contract is already active, you must provide immediate proof of active registration with the Agencia Tributaria and RETA. Pledges are not accepted in this scenario.
UGE TOUGHENS STANCE ON AUTÓNOMO REGISTRATION
The UGE has significantly tightened its stance on DN residency holders transitioning to or holding self-employed status:
- Zero Grace Period for Registration: As soon as you receive authorization/permission to work as self-employed in Spain (or reach your designated contract start date), you MUST register immediately as autónomo with both the Agencia Tributaria (Tax Agency) and RETA (Social Security). There is no buffer period allowed after permission is granted.
- Active Cross-Checks: UGE actively verifies Social Security and tax databases. If you were granted DNV residency as self-employed, your active RETA enrollment date must align immediately with your authorization.
If you apply using a commitment pledge, completing your Autónomo setup on Day 1 of your contract is mandatory. The UGE will almost always look up your Social Security status before giving you the green light.
Unless you terminate your employment early, the ideal start date for your self-employment contract is the day immediately following the end of your A1 coverage. If you are currently under the Beckham Law regime, consult a tax advisor before switching, as aligning this transition with the tax year end on December 31 is generally recommended.
Application Documents
| Document Requirement | Notes |
|---|---|
| New Service Contract(s) | Client agreement(s) explicitly permitting remote work as an independent contractor. To secure the full 3-year permit, these contracts should be indefinite. |
| Spanish Autónomo Pledge/Proof | Depending on application timing, either a signed commitment pledge to register as autónomo on Day 1 of your new contract OR official proof of active self-employment registration in Spain (Tax Form 036/037 and RETA enrollment). Note that UGE reviewers expect your registration to be fully active starting precisely from Day 1 of your new contract. |
| Company Authorization Letter | A formal letter from your primary client(s) explicitly permitting you to perform your professional services remotely from Spain as a self-employed contractor. |
| Proof of Company Existence | Certificate of Good Standing or Commercial Registry extract for your primary client company proving it has been active for at least 1 year. |
| Qualifications / Experience | Proof of a higher education degree or at least 3 years of verifiable professional experience in your field. Note: Time worked in Spain under your previous DNV employee status counts directly toward this 3-year requirement. |
| Criminal Record Check | EXEMPT Since you have lived legally in Spain with a TIE card for over 6 months, you do not need to request a new criminal record check from your home country. |
| Civil Certificates (Birth/Marriage) | PRACTICALLY WAIVED While civil status certificates are officially waived only for standard renewals, UGE almost always waives resubmission for status switches if your family links are already established in their system. |
| Application Form | Official Formulario MIT (Initial). Can be signed manually or electronically; using a digital certificate (certificado digital) is recommended but not mandatory. |
| Valid Passport | Full-page scan of your valid passport photo page. Must be valid at the time of filing—does not require a full year of remaining validity. |
| Proof of Fee Payment | Modelo 790 Code 038: Standard initial processing fee (€73.26), rather than the renewal fee rate. |
Quick tip: Even though tax returns aren't on the official checklist, it's definitely a good idea to make sure your Spanish taxes are completely up to date before applying. The UGE can—and often does—check up on this.
