If you’re currently applying for Spain’s Digital Nomad Residency (DNV) for the first time or gearing up for a renewal, you’ve probably noticed the landscape is shifting pretty fast.

Between the latest updates directly from the Director of the UGE (Unidad de Grandes Empresas y Colectivos Estratégicos) and what we are seeing boots-on-the-ground every single day, here is the honest, unvarnished truth on where things stand right now.

1. UGE Assessors Are Toughening Up

If you’ve been following Spanish immigration for a while, you’ll know this pattern well: UGE assessors almost always tighten administrative standards and scrutiny every autumn.

Right now, the office is processing a massive volume—roughly 140 to 150 primary applications every single day (and that’s before you even count dependents!). With backlogs building up, assessors are taking a much firmer, uncompromising stance on incomplete, vague, or borderline files.

The Summer "Positive Silence" Catch

Over the summer, a wave of applications blew past the official 20-working-day statutory deadline, technically triggering positive administrative silence (silencio administrativo positivo). While Spanish law states that an application is deemed approved if the UGE misses its deadline, don't rely on this as a shortcut.

The UGE is actively reviewing these "silent approval" files during renewals or audit checks. If the underlying application didn't actually meet the strict legal criteria to begin with, a later file review can void your residency - leaving you right back at square one.

2. Serious Fraud Crackdowns & Strict New Document Rules

Processing delays aren't just down to sheer volume; they are heavily driven by fraud detection. UGE assessors have been discovering an influx of fake documents across the board - from fabricated client contracts to falsified bank statements.

Here is how they are clamping down:

  • Digital Certificates for Sworn Translators: Fake sworn translations became such a rampant issue that UGE assessors now strictly accept translations signed using the official translator’s verified digital certificate. Scanned paper copies with manual stamps are quickly becoming a thing of the past.
  • Police Cooperation & Original Paperwork: The UGE now works in direct coordination with the Spanish national police to cross-check file authenticity. If an assessor flags anything suspicious, you will be hit with an official request (requerimiento) to submit physical original documents.
  • Schengen Visa Misuse: Thinking of grabbing a short-stay Schengen tourist visa from another country just to pop into Spain and apply? Be careful. Using another country's tourist visa as a temporary bridge while prepping your Spanish residency documents is increasingly being flagged as an abusive use of the Schengen visa convention.

3. Bad News for UK Company Owners

Under current strict interpretations by UGE assessors, the days of UK company owners applying cleanly with an HMRC A1 certificate are all but over.

Because of the strict 3-month self-employment rule, it is notoriously tricky (though not impossible) for UK company directors to invoice their own business cleanly without getting on the wrong side of HMRC.

As we certainly don't want to contribute to borderline or risky applications just to make a file "fit", we've submitted a formal "suggestion" to the UGE asking them to relax the 3-month self-employment history criteria for company directors, and we'll keep you posted as soon as there's any official movement!

4. Retroactive Registrations, Cheap Tax Providers & Our Updated DNV Packages

  • Retroactive Self-Employment Registrations Are Unblocked: We recently went through a stressful patch where retroactive autónomo (self-employment) registrations were completely blocked by the administration. Luckily, things have smoothed out, and completing retroactive registrations within 15 working days is possible once again.
  • "Cheap" Tax Providers Can Cost You €€€€s: The Director of the UGE frequently mentions that self-employment registration can be done quickly via the government platform, CIRCE. However, it is an incredibly inflexible system. At this time of year, most Digital Nomads do not want to become Spanish tax residents for the current calendar year. With CIRCE (which is what most high-volume tax providers who do free "altas" use), there is simply no technical option to register as a non-tax resident.
  • Proactive Protection in Our DNV Packages: Many applicants who filed back in 2023 are currently getting hit with mandatory retroactive registrations upon renewal—racking up estimated surprise costs of as much as €10,000. To shield our current clients from these hidden future costs and compliance headaches down the road, we now fully include self-employment registration directly inside our DNV application packages.

5. Industry Shift: Why Reputable Advice Actually Matters

With UGE assessors enforcing stricter standards than ever, the era of quick hacks, social media shortcuts, and DIY guides is officially over. We’ve already noticed several prominent "DNV influencers" and unlicensed pop-up agencies quietly packing up shop as the UGE closes loopholes.

Navigating Spanish cross-border immigration requires real institutional rigor, not guesswork. Move To Spain Guide was founded by a former PwC-trained Chartered Accountant turned licensed Spanish Economist (Colegiado de Economistas).

Unlike unaccredited advisors, "agencies," or DNV influencers, a Colegiado de Economistas:

  • Is bound by a strict professional code of ethics.
  • Must carry mandatory Professional Civil Liability Insurance.
  • Is subject to formal disciplinary oversight by their official professional body.

Working with a qualified, regulated firm ensures your cross-border business structure, tax positioning, and residency application are seamlessly aligned - giving you the legal recourse, professional accountability, and rock-solid reliability you need to protect your new life in Spain.
